Terms of Engagement
Every tactical engagement with Vajra Cyber Defense is governed by a framework of professional integrity, technical precision, and legal transparency. These terms define the parameters of our relationship as we work to fortify your digital sovereignty.
1. Scope of Tactical Operations
Vajra Cyber Defense ("Vajra") provides specialized cybersecurity services, including but not limited to tactical penetration testing, vulnerability assessments, security architecture design, and incident response. The specific objectives, methodologies, and deliverables for each engagement will be defined in a separate Statement of Work (SOW) or Service Agreement.
By accessing our website or engaging our services, you ("Client") agree to these Terms of Engagement. These terms represent a binding legal agreement between the Client and Vajra, headquartered in Hyderabad, Telangana.
2. Authorization for Security Testing
For all offensive security services, including penetration testing and Red Team operations, the Client explicitly authorizes Vajra to perform the agreed-upon tactical exercises on the Client's infrastructure. The Client represents that they have the legal authority to grant this permission for all targeted networks, systems, and applications.
Vajra will conduct all testing within the "Rules of Engagement" defined in the SOW. While we take every precaution to minimize operational impact, the Client acknowledges that security testing involves inherent risks to system stability and uptime. Vajra shall not be liable for any incidental disruptions occurring within the authorized scope of testing.
3. Professional Integrity & Confidentiality
Due to the sensitive nature of our work, both parties agree to maintain the absolute confidentiality of all "Strategic Intelligence" shared during the engagement. This includes technical configurations, discovered vulnerabilities, intellectual property, and proprietary methodologies.
Vajra's team members are bound by rigorous non-disclosure agreements and have undergone extensive background verification. We maintain a "Zero Leak" policy. Any reports or briefings provided to the Client are for their internal use only and may not be disclosed to third parties without Vajra's explicit written consent.
4. Intellectual Property & Sovereignty
All proprietary software frameworks, "Vajra Shield" architectures, and tactical methodologies utilized by Vajra remain the exclusive intellectual property of Vajra Cyber Defense. The Client is granted a non-exclusive, non-transferable license to use the deliverables (e.g., security reports, custom scripts) solely for their internal defensive purposes.
The Client maintains absolute sovereignty over their own data. Vajra does not claim any ownership rights over information processed during the course of an engagement.
5. Professional Fees & Resource Allocation
Fees for tactical engagements are calculated based on the complexity of the infrastructure and the required depth of intelligence gathering. Payment terms are defined in the specific Service Agreement. Late payments may result in the suspension of continuous monitoring services and the deactivation of tactical response readiness.
All fees are non-refundable once the engagement has been initiated, as resources are allocated and mobilization protocols are activated upon the signing of the SOW.
6. Limitation of Liability
Vajra provides expert-grade security services, but the Client acknowledges that no system is truly "unbreakable" in perpetuity. Our services represent a snapshot of your security posture at a specific point in time. Vajra shall not be liable for breaches occurring after the conclusion of an audit or resulting from the Client's failure to implement recommended remediation strategies.
In no event shall Vajra's total liability exceed the fees paid by the Client for the specific engagement giving rise to the claim. We are not liable for indirect, consequential, or punitive damages.
7. Ethical Use of Services
Vajra's services are intended exclusively for the fortification of legitimate digital assets. The Client agrees not to use any intelligence, tools, or methodologies provided by Vajra for offensive purposes against third parties or in violation of any applicable laws, including India's Information Technology Act and DPDP Act.
8. Jurisdiction & Dispute Resolution
These Terms of Engagement are governed by the laws of India. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana. We encourage the resolution of all strategic differences through high-level executive consultation before seeking legal recourse.
9. Termination Protocol
Either party may terminate an engagement with 30 days' notice, subject to the fulfillment of outstanding financial obligations. In the event of a breach of confidentiality or ethical protocols, Vajra reserves the right to terminate services immediately and revoke all tactical support.
